Does anyone know if in Bulgaria, as the apartment (I am buying) is being bought off plan, the builder's bank could issue me with a bank guarantee? To protect me against the builder going bankrupt. Using the guarantee, should I then be entitled to my money back? :confused:
I have also received my contract, but should it contain a clause regarding the completion time & if the work over runs the completion date of 30th Sept. 2006? There are clauses in for late payment of 0.1% per day (of the price of the apartment); should there also be 0.1% per day to myself for everyday the work over runs?

Hi Stevie
I think you (and also some others on this forum) could do with some professional advice which is not based around the agent or the constructor. It would seem that you would do best to send your contract to an independent bg lawyer who would act in your interests and not that of the vendor or the agent.
The big problem with the internet is that anyone can say what they like about anything (not like printed material where you would be sued senseless for that kind of thing)... and so it is easy to get misled and cheated; meeting people who hide behind their name on forums.

Thanks for your email. Whilst I am sure of some things I am not sure of others.... so I have passed this to the lawyer who writes for Quest Bulgaria for his comments. He is a thoroughly trustworthy and independent person, and also was the lawyer for the BG Consul in London for many years, so understands your questions and your worries.
He may not reply for a couple of days as he is a busy person, but he will certainly answer what you have raised. I'll get back to you soonest by email.... also maybe your questions could be good for the magazine to help others? I think so.. that way they can avoid the problems you have encountered so far.
